Technically it is SML's and its young fan base fault for using Nintendo's characters in inappropriate manner that caused Nintendo to warn Logan and the crew.
@Drake Marvin SMG4 content isn't as bad as SML's when it comes to notorious adult jokes, it's more around memes meaning it hints at any sort of comedy. Yes he does use the Mario character inappropriately but at times now. Besides that, SML is has a wider audience, seen by probably twice or even 3 times as much as the number of people that watch SMG4 videos, including kids.

Also, it would be easier for Nintendo to send messages and letters to SML than it would be to random shitposters who upload a 10 second video of Mario saying the F word. Yes he does use the Mario character inappropriately but at times now. Besides that, SML is has a wider audience, seen by probably twice or even 3 times as much as the number of people that watch SMG4 videos, including kids.

Also, it would be easier for Nintendo to send messages and letters to SML than it would be to random shitposters who upload a 10 second video of Mario saying the F word. If we focus on the plush community, SML is the biggest plush channel that uses these characters and by being the biggest, it's obviously going to attract attention.
