During a trial, only facts are accepted. Possibilities are not, especially if that means accusing someone like Athena did. That's why the judge went mad when she retracted her accusation. Accusing an innocent like that to save your client is a very serious mistake a defense attorney can make. But she's only 18 and literraly only just started her carreer, so of course she's doing mistakes like that. She only has done one case at this point, and there was Apollo by her side at all time. Apollo's not here to help her this time, so she couldn't know she was doing a grave mistake. Also, you may have forgotten since that's been months since the last time you saw Elements of Justice, but Athena mentioned that she and her friend had been suspected in her mother's murder. What she didn't say however is that it caused her to be very traumatised and scared of courtrooms, to the point that she even had black psyche-locks (you may remember that Trixie had those as well in Turnabout Storm). That trauma has been resolved but Elements of Justice started one or two months after that, so she basically don't have any real trial experience.
